Negotiation & Conciliation
Maintaining good and honest relationships throughout the construction supply chain is coming under increasing pressure. A more stressful and litigious environment has made it all the more crucial to resolve difficulties as soon as they arise to keep team members confident and projects moving forward. Alternative Dispute Resolution, such as conciliation, mediation and adjudication can be very effective in resolving disputes, and in the event of a claim for additional reimbursement or contractual breach being made, we have the negotiation skills and expertise to prepare & present the facts to our clients best advantage either in pursuance or defence.

Adjudication (Security of Payments)
Under the “Housing Grants, Construction and Regeneration Act 1996” it is the statutory right given to every party to a "construction contract" to refer a dispute to adjudication. The contract provides that the decision of the adjudicator is binding until the dispute is finally determined by legal proceedings, by arbitration (if the contract provides for arbitration or the parties otherwise agree to arbitration) or by agreement. can adjudicate or offer expert advice with all manner of disputes, including delays, additional cost claims, variations, valuation of work and defective work, and at any phase where the parties involved wish to avoid litigation or arbitration.
Arbitration
As arbitration can be a costly option to take, we endeavour wherever possible to assist our client to resolve the situation through negotiation in the first instance. Failing this, we can provide a detailed analysis of the financial and non-financial risks of undertaking arbitration and draw up a strategy and budget for the case. We would then develop the case for settlement and manage the subsequent adjudication and arbitration proceedings.
Litigation
The last resort. If litigation is necessary we can provide our clients with the necessary support for Court proceedings. |
